1. Introduction

Welcome to TuneGains ("we", "our", "us"). These Terms of Service ("Terms") govern your use of our website located at tunegains.com and our SaaS widget service (together, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

• "Service" means the TuneGains website and embeddable tuning data widget.
• "Subscriber" means any individual or business that subscribes to our paid plans.
• "End User" means visitors to a Subscriber's website who interact with the widget.
• "Content" means all tuning data, text, graphics, and other materials provided through the Service.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"), either monthly or annually, depending on the plan you select.

At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or we cancel it.

All payments are processed securely through Stripe. We do not store your payment card details.

5. Cancellation and Refunds

You may cancel your Subscription at any time through your account dashboard. Upon cancellation:

• Your subscription will remain active until the end of your current billing period.
• You will not be charged for subsequent billing periods.
• No refunds will be provided for partial months or years of service.

Under the Consumer Contracts Regulations 2013, you have the right to cancel within 14 days of purchase for a full refund, provided you have not used the Service.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by TuneGains and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive license to use the widget on your website(s) for the duration of your Subscription.

7. Data Accuracy

The tuning data provided through the Service is for informational purposes only. While we strive to provide accurate performance estimates, actual results may vary based on vehicle condition, modifications, and other factors.

TuneGains is not liable for any decisions made based on the data provided through our Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TuneGains be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
